TTDC Policy-004 Terms of Trade

Thanks for choosing Tasmania Tech & Dive Centre. These Terms of Trade apply to online orders, retail purchases, course bookings, guided dives, club membership, equipment services, gas services, hire and other TTDC services.

These terms should be read with our Privacy Policy, Shipping Policy, and Returns, Refunds and Reservations Policy. Nothing in these terms excludes, restricts or modifies any rights you have under the Australian Consumer Law or any other laws that cannot be excluded.

1. Website and Online Store Information Disclaimer

Tasmania Tech & Dive Centre takes reasonable care to ensure that information published on its website and online store is accurate, current and complete. However, to the maximum extent permitted by law, TTDC does not warrant or represent that website content, online store content, product descriptions, images, specifications, prices, availability, course information, dates, inclusions, third-party supplier information or other published material will be free from error, omission, delay or change. TTDC may correct, amend, update, withdraw or vary any website or online store information at any time before an order or booking is confirmed. Where an error or omission materially affects an order or booking for which payment has been received, TTDC will contact the customer and offer an appropriate remedy, which may include correction, resupply, rescheduling, credit, transfer or refund, having regard to the circumstances and any rights that cannot be excluded under the Australian Consumer Law.

2. Orders, Bookings and Payment

An order or booking is confirmed when we accept it and receive the required payment, deposit or booking information. Prices are shown in Australian dollars unless stated otherwise. Before confirmation, we may need to check pricing, stock, supplier availability, course dates, minimum numbers, freight, safety, weather or operational requirements. If we identify an issue after you have paid, we will contact you and offer a suitable option such as correction, rescheduling, credit, transfer or refund, depending on the circumstances and your legal rights.

3. Products, Special Orders and Delivery

Some products may be specially ordered, custom configured, bulky, collection-only or subject to supplier, manufacturer or freight restrictions. We will let you know if extra lead time, collection requirements or special-order conditions apply. Once a special order has been committed to a supplier or customised for you, cancellation or change-of-mind return options may be limited unless required by law. Delivery and collection are handled under our Shipping Policy. Delivery estimates are guides only unless we expressly confirm a firm delivery date.

4. Training, Diving and Safety Requirements

Diving, snorkelling and boating involve inherent risks. Participation in training, guided dives, club activities and other in-water services is subject to safety, suitability, certification level, experience, medical fitness, equipment readiness, weather, site conditions and completion of required forms. This may include waivers, releases, medical questionnaires, parental or guardian approvals, proof of certification and emergency contact details. If requirements are not met, we may postpone or refuse participation.

Our instructors, dive supervisors, skippers and authorised staff may make safety decisions at any time, including changing the site, changing the schedule, reducing activity scope, delaying entry, ending a dive, refusing participation, requiring different equipment or cancelling an activity. Certification is not guaranteed by attendance alone and is issued only when all required learning, skills, paperwork, safety expectations and payment requirements are complete.

5. Club Membership and Member Activities

Club membership is currently offered at $100 per year. Membership gives eligible certified divers access to selected member opportunities, but does not guarantee a place on any specific boat dive, event, discount, trip or activity. Member activities may be subject to active membership, sign-in requirements, waivers, medical declarations, certification checks, experience checks, weather, vessel availability, cost-sharing contributions and directions from the skipper, instructor or dive supervisor.

6. Cancellations, Refunds and Consumer Rights

Cancellations, transfers, booking changes, credits and refunds are handled under our Returns, Refunds and Reservations Policy and any specific conditions stated for the product or activity. Some bookings or orders may involve non-recoverable costs such as course materials, online learning, instructor time, supplier commitments, special orders, travel providers, freight, private coaching preparation, vessel planning or limited places.

Your rights under the Australian Consumer Law are not excluded, restricted or modified. If goods or services fail to meet a consumer guarantee, you may be entitled to a remedy such as repair, replacement, resupply, refund, cancellation or compensation. Change-of-mind returns, discretionary transfers, store credits and non-fault exchanges remain subject to our Returns, Refunds and Reservations Policy.

7. Liability, Privacy and Governing Law

You are responsible for following instructions, diving within your certification and experience, using suitable equipment, and telling us promptly about any medical, fitness, equipment or safety issue that may affect participation. To the extent permitted by law, we are not liable for indirect, consequential or purely economic loss arising from delays, postponed activities, supplier issues, freight disruption, weather, missed opportunities, inaccurate customer information or failure to follow safety directions. Nothing in this clause limits liability that cannot legally be limited.

Personal information is handled in accordance with our Privacy Policy. These terms are governed by the laws of Tasmania and the laws of Australia that apply in Tasmania. We may update these terms from time to time, and the current version published on our website applies unless we tell you otherwise.
